A leading driver and strong advocate for European Businesses in Korea
Seminar on the Unitary Patent and the Unified Patent Court
On April 7, the ECCK and the European Patent Office (EPO), together with support from the Korean Intellectual Property Office (KIPO), organized the ‘Seminar on the Unitary Patent and the Unified Patent Court: Benefits and Essential Information.’ Taking place at Hotel the Plaza, the day’s seminar was featured by approximately 100 participants. Mr Seong Joon Park, Director General of the Intellectual Property Protection & International Cooperation Bureau at KIPO, opened the seminar with the welcome remarks.
The seminar was divided into two sessions, both presented by Ms. Margot Fröhlinger, Principal Director of Patent Law & Multilateral Affairs at EPO. During the first session, Ms. Fröhlinger presented on the Unitary Patent, a single patent right valid in up to 26 EU member states. As until now, it is only possible to register patents in a single country, and the Unitary Patent system will result decrease in applicable costs, increase in efficiency and enhance harmonization across the participating member states. The second session was focused on the Unified Patent Court (UPC), the supranational court with jurisdiction over Unitary Patents. Ms. Fröhlinger covered various aspects of the UPC including the court procedure, the available remedies and the appeal procedure as well as applicable court fees, recoverable costs and costs for opt-out.
As a final positive note, Ms. Fröhlinger mentioned that the United Kingdom had announced in last November that it would continue its preparations to join the Unitary Patent system and that such was on schedule, leading to the system to take effect at the end of 2017. The ECCK will work collaboratively with the EPO again for this year’s IPR Conference, which is set for the end of October, to provide an update on the development over the next few months.
